Well its exactly a year today we had to make ourselves bankrupt and have not heard a dicky bird from the receiver since. They said we automatically get discharged after 1 year so does that mean that we are now discharged and it is too late for them to give us and ipa? we were never given one initially as after our income and expenditure was taking out we was -£300 a month so there so no surplass money to pay back. I am wondering if thats why we havent had an income and expenditure review before our discharge.

Wow EM12, doesn't time pass quickly. I hope everything has gone smoothly over this year. As far as I am aware it is quite normal to hear nothing from the OR if you have been automatically discharged. To make sure the best thing to do would be give the OR a call or send them an e-mail and ask them to confirm that you have been discharged. I am sure that the answer will be yes. As such there is no risk you will get a IPA now.

Have a quick chat with the OR and see what they say. However if your situation is anything like that of ljwilson1 then I am sure you have nothing to worry about. Their situation seems to be the same as yours. Have a look here: viewtopic.php?f=52&t=17796

If you have heard nothing from your IP then I am sure you have been automatically discharged and that will be that. The Official Receiver does not always feel it is necessary to ask for an income and expenditure review before discharging you especially if your income was always far lower than your expenses.

Hayden gives some good advice when he says it is worth contacting your OR to confirm the situation. At least that would give you peace of mind. However it certainly sounds as though you are discharged to me and given that it is no longer possible for the OR to initiate an income payment agreement (IPA).

You could also check on the insolvency register to see if your details are still there. However remember it can take up to 3 months for the details of your bankruptcy to be removed after your discharge.
